📄 Agreement to Terms

• By registering or using our services (“Services”), you confirm that you have read, understood, and accepted the terms below.
• ShakerGainsKE.com is not responsible for any loss incurred by users who have not read these terms.

1. General Terms

• Placing an order on ShakerGainsKE.com means you automatically accept all terms.
• We may change these terms at any time without notice.
• All users must comply with platform policies (Instagram, Facebook, Twitter, YouTube, etc.).
• Rates are subject to change without notice. Refund terms remain fixed.
• Delivery times are estimates — no exact time is guaranteed.
• We may adjust service type to ensure completion of your order.

2. Definitions

• Services: Digital marketing tools including followers, likes, views, comments, and engagement.
• User: Anyone using ShakerGainsKE services.
• Platform: Third-party networks like Instagram, Facebook, Twitter, TikTok, etc.
• Content: Any data or media you submit or that we generate on your behalf.

3. Scope of Services

• We offer non‑organic digital engagement for branding and visibility.
• These may be bot‑generated or incentivized and do not guarantee genuine user interest, conversions, or endorsements.
• Guaranteed services are clearly mentioned. In case of any failure or delay, we either refund to your panel balance or resolve the issue quickly usually within 0–168hrs Max.

4. Service Use

• Services improve appearance only — no engagement is guaranteed.
• Accounts may lack bios, profile pics, or uploads.
• Uploading inappropriate content (nudity, hate speech, etc.) is prohibited.
• Private accounts will not receive service and will not be refunded.
• Ensure your account or post is public and interaction-enabled before ordering.

5. Payment & Billing

• All services are prepaid. Wallet must be funded before ordering.
• Wallet balances are non-withdrawable and non-refundable.
• All prices exclude taxes. Orders may be suspended if balance is insufficient.

6. Privacy Policy

• We only collect the data necessary to process your orders.
• We value your privacy and protect your data fully.
• Information is used only for processing your orders.
• No personal information is ever sold or shared.
• All data is encrypted and stored securely.
• We comply with relevant data protection laws (e.g. IT Act, CCPA).

7. Refund Policy

• All deposits are final and cannot be reversed.
• No refunds due to the digital nature of our services.
• Refunds (if applicable) are issued as panel credits only not source of funds.
• If a service is not delivered or has issues, the amount will be added back to your panel balance. You can use this balance for other services.
• Misplaced or private account orders are not eligible for refund.
• Fraudulent activity = permanent ban. No exceptions.
• Do not use more than one server on the same post/link — no refund in this case.
• No refunds for completed or duplicate orders.

8. Intellectual Property

• All logos, software, and designs belong to ShakerGainsKE or its licensors.
• You may not copy or use our assets without written consent.

9. Use of Third-Party Trademarks

• Platform names (e.g., Instagram, TikTok) are used for reference only.
• We are not affiliated, endorsed, or sponsored by these platforms.
• If any trademark owner requests removal of their name or logo from our site, we will comply upon receiving prior written notice at [email protected]. Our use of these marks is permitted under nominative fair use provisions of applicable trademark law.

10. User Conduct

• Do not use our services for spam, phishing, hate speech, or illegal activity.
• Unauthorized reselling, redistribution, or exploitation is strictly prohibited.

11. Refill Updates & Failures

• We offer refills on selected services, subject to the original terms at the time of order.
• Refills are void if the username is changed, or if another order is placed on the same profile before the refill is complete.
• We only refill drops from our services — not others.
• Refill may fail if user blocks you or if platform updates are occurring.

12. Cheapest vs Best Speed

We recommend Best Speed services for faster and reliable results. Cheapest services may be slower and require patience.

13. Refill & No-Refill Services

Non-refill services are used at your own risk. Refill or partial refund is only applicable to guaranteed services.

14. Drop Disclaimer & Server Usage

• Drops may occur naturally in digital services.
• Not all drops qualify for refill. Read carefully before ordering.
• Do not use multiple services/servers on the same link — no refund/refill in such cases.

15. Link Validity & Public Access

Only public and valid links are accepted. Invalid or private links will not be refunded.

16. Indemnification

You shall indemnify and hold harmless ShakerGainsKE from claims, losses, and legal expenses arising from misuse of our services or breach of terms.

17. Limitation of Liability

We are not liable for indirect, incidental, or consequential damages, or platform actions like suspensions or bans.

18. Account Security

Protect your login credentials. Use 2FA. Do not share your account with anyone.

19. Force Majeure

We are not liable for natural disasters, API failures, or legal interruptions beyond our control.

20. Governing Law & Dispute Resolution

Terms governed by Kenyan law. Arbitration in Kisii will be the first dispute resolution step.

21. Final Terms

Respect our team. We may block abusive users. Invalid clauses don’t affect the rest. Use of our platform means acceptance of these terms in full.
